Terms of Use

These terms apply to all apps published by helptothetop (operated by Farrier Holding Limited): BabySteps, SpeedRead, Songbird, and BillMD.

1. Acceptance of Terms

By downloading, installing, or using any of our apps, you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use our apps.

2. Eligibility

You must be at least 16 years of age to create an account and use our apps. If you are under 18, you confirm that you have your parent or guardian's consent. Apps designed for use with children (BabySteps, Songbird) are intended to be operated by a parent or guardian.

3. Account Registration

Some features require an account. You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate information and to update it as needed.

4. Subscriptions and Payments

Subscription Plans

Our apps may offer free and premium tiers. Premium features require a paid subscription. Prices are displayed in the app and in the Apple App Store or Google Play Store before purchase.

Billing

  • Payment is charged to your Apple ID or Google Play account at confirmation of purchase
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
  • You can manage and cancel subscriptions in your device's account settings

Refunds

Refunds are handled by Apple or Google according to their respective refund policies. We do not process payments directly and cannot issue refunds ourselves. If you have a billing issue, please contact support@helptothe.top and we will help where we can.

5. Acceptable Use

You agree not to:

  • Use our apps for any illegal purpose
  • Attempt to gain unauthorised access to our systems
  • Reverse-engineer, decompile, or disassemble the apps
  • Upload harmful, offensive, or infringing content
  • Use automated systems or bots to access the apps

6. Intellectual Property

All content, designs, code, and trademarks in our apps are owned by Farrier Holding Limited or our licensors. You may not copy, modify, or distribute any part of our apps without written permission.

Content you create within our apps (diary entries, reading libraries, song requests, etc.) remains yours. By using our services, you grant us a limited licence to store and process your content solely to provide the service.

7. App-Specific Terms

BabySteps

BabySteps is not a medical device and does not provide medical advice, diagnosis, or treatment. Milestone information and activity recommendations are for general guidance only. Always consult your child's healthcare provider for medical concerns.

SpeedRead

Reading speed improvements vary by individual. We make no guarantees about specific speed or comprehension outcomes. Imported content must comply with applicable copyright laws.

Songbird

Songs are generated using AI technology. Generated content is provided for personal, non-commercial use. We do not guarantee the suitability of all generated content and encourage parental review.

BillMD

BillMD provides informational analysis only. It is not a substitute for professional legal, financial, or medical billing advice. Analysis results are estimates and may not reflect actual billing errors. We are not liable for outcomes of any billing disputes.

8. Disclaimers

Our apps are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that our apps will be uninterrupted, error-free, or free of harmful components.

9. Limitation of Liability

To the maximum extent permitted by law, Farrier Holding Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our apps, including but not limited to loss of data, loss of profits, or business interruption.

10. Account Termination

You may delete your account at any time through the app settings. We may suspend or terminate accounts that violate these terms. Upon termination, your data will be deleted in accordance with our Privacy Policy.

11. Changes to These Terms

We may update these terms from time to time. When we do, we will update the "Last updated" date. Continued use of our apps after changes constitutes acceptance of the new terms.

12. Governing Law

These terms are governed by the laws of New Zealand. Any disputes shall be subject to the exclusive jurisdiction of the courts of New Zealand.
